Derry judge hits out at court delays

Derry Magistrate's Court

A man has been returned for trial to Derry Crown Court on charges of burglary and attempted burglary following a Preliminary Enquiry at Derry Magistrate's Court.

John Paul McGilloway (43) of Collon Terrace in Derry was charged with burglary with intent to steal at commercial premises between February 1 2023 and April 1 2023 and attempted burglary with intent to steal on April 19 2023 and between May 5 and May 9 2023.

It was accepted that there was a case to answer and there were no contrary submissions.

McGilloway chose not to make any statements and not to call any witnesses.

He was returned for trial to Derry Crown Court on February 19.

Following the PE the defendant applied for bail on the grounds he had been in custody for a lengthy period of time.

Defence counsel Stephen Mooney said that his client had an atrocious record but had not ever carried out a domestic burglary.

Deputy District Judge Brian Archer said that McGilloway had 'one of the worst records I have ever seen both as a solicitor and a judge'.

He said that there was 'no gap' in McGilloway's offending since 1998 with 75 convictions for burglary.

The judge said that the defendant had 'brought this on himself' and refused bail and McGilloway was returned for trial to Derry Crown Court on February 19 in custody.
