Derry Magistrates' Court
A man who is on bail on condition he does not contact his alleged victim has had a breach of bail charge dismissed at Derry Magistrates' Court.
James Kelly (38) of Duncreggan Road in Derry appeared charged with breaching his bail.
A police officer told the court that the alleged injured party in the case claimed she had been in the Victoria car park with friends when the defendant joined them and began verbally abusing her calling her 'a touting b-----d'.
She also claimed that on the previous day he had stood across the road from her watching her and putting her 'in genuine fear.'
The officer said there was 'an extensive domestic history between the pair'.
Defence counsel Stephen Chapman said that his client did not accept the breach.
Deputy District Judge Chris Holmes asked had the woman actually made a statement about the incident and was told that she couldn't make one yesterday as she was intoxicated but had said she would come to the police station today.
He said that he was being asked to accept hearsay of hearsay and this was not acceptable and dismissed the charges.
