Derry man remanded on bail breach following 'clear warning' by previous judge

Suspended sentence for Donegal man at Derry Magistrate's Court

A man currently on bail for robbery charges who has a curfew and alcohol condition was found with a breath test reading of 116mgs more than three times the legal limit. 

Patrick Kelly (18) of Northland Road In Derry was charged with breaching his bail at the weekend.

The court was told that at 1.20am on November 29 police were called to the bus station to an incident where a man was refusing to leave a bus.

Police located Kelly who was found to be in breach of his curfew and his alcohol reading was over three times the limit.

A police officer said this was Kelly's third breach of bail and he had been given a 'clear warning' by a previous judge.

Defence counsel Stephen Chapman said that Kelly had 'an issue with alcohol' in that all he had to do was stay off alcohol and had been unable to do that.

He added that it could be some time before the case was dealt with. 

District Judge Oonagh Mullan said that on the last occasion Kelly had been made aware of the consequences of breaching his bail. 

Kelly was remanded in custody to appear again on December 22.
