A fifty-seven years old man with an address in England who denied two charges involving sex assaults on a female walked free from Derry Crown Court today when the prosecution offered no evidence in relation to the charges.
A jury was sworn in to hear the case before Judge Roseanne McCormick KC.
The defendant, Lawrence Dodd Kendall from Stoneleigh Road in Oldham, had been charged with two offences of sexually assaulting the child, including one involving penetration, on dates between July 25 and July 28, 2016.
However a prosecution barrister told the court "we will not be offering evidence in this trial".
Judge McCormick told the jurors there "was no evidence on which a jury could make a decision" and she instructed the jurors to return a verdict of not guilty by direction.
She then added "the defendant is therefore free to leave the dock".
