Judge issues stark warning to Derry man who breached bail curfew

A man who disputed he had breached his bail has been re-released at Derry Magistrate's Court with a warning from the judge.

Ethan McDonnell (38) of Margaret Street in Derry appeared charged with breaching his curfew by not being at his residence. 

A police officer said that the electronic monitoring service said that it showed McDonnell was not present in his property. 

Phone calls were made and went unanswered and police called to the address and knocked for five minutes but there was no answer. 

Defence solicitor Paddy MacDermott said that his client didn't accept there had been a breach and claimed he had been home all night.

He said the defendant's wife was present in court and was prepared to give evidence to that effect. 

The solicitor said that both parents slept heavily after a busy day with their child and simply did not hear the phone or the police knocking.

He further said that someone from the monitoring service had been at the property and said the equipment was faulty.

Bail was granted but District Judge Oonagh Mullan warned McDonnell that any breaches could lead to him going into custody.
