Assault case against Derry man adjourned after judge questions charge

The case against a man who admitted assaulting another man in an incident outside a bookmakers was adjourned at Derry Magistrate's Court after a judge queried the charge.

Ryan Mallett (33) of Berryburn Park in Derry admitted a charge of assault that occurred on March 29 this year.

The court heard that the injured party reported to police that he had been assaulted by Mallett.

He said Mallett had followed him into a bookmakers shop and grabbed him by the throat. 

The victim said he was pulled into the street and Mallett squeezed his throat until he lost consciousness. 

District Judge Oonagh Mullan said that it was unusual that he was only charged with common assault. 

Defence solicitor Paddy MacDermott said that his client would be disputing the details of the assault. 

A prosecutor said that there was CCTV of the incident and suggested that that should be examined to see what the proper charge should be.

The case was adjourned until November 17.
