Derry man charged with making threats to kill and witness intimation

Jason Barton (33) of Clon Elagh in Derry was charged with the offences

Suspended sentence for Donegal man at Derry Magistrate's Court

A man has appeared at Derry Magistrates Court charged with making threats to kill, threatening to damage property and witness intimation.

Jason Barton (33) of Clon Elagh in Derry was charged with the offences that were said to have occurred on August 18 after the alleged injured party told police about a message that had been posted on Facebook threatening to, amongst other things, burn his house down regardless if his children were inside and calling him a 'dead man walking'.

Police later attended Barton's address and arrested him.

When interviewed, he denied sending the messages and police pointed out that, had he sent it directly to the alleged injured party, that he would've been in breach of his bail but as he posted it to Facebook it was in the public domain.

Police objected to bail as Barton is currently on bail for three other charges and they believe he is at risk of reoffending.

Defence Barrister Stephen Mooney, when applying for bail, said that Barton's other charges don't involve the alleged injured party, adding that he denies that it is him in the video as his face is not visible in the recording.

He also said that Barton had offered police access to his phone to show that there was no digital footprint linking it to him.

Bail was granted and he will appear again on October 10.
