A man has appeared at Derry Magistrates' Court charged with driving without due care and attention and drink driving.
Mark McDaid (21) of Hillview Avenue in Derry was charged following a single-vehicle collision on January 1 last year where he collided with a traffic island and a wall, badly damaging the vehicle.
When police arrived, a number of emergency services were already at the scene and McDaid was in the back of an ambulance where police performed a blood test that gave a reading of 101mg, which was over the legal limit.
The passenger in the car was also badly injured, suffering a broken vertebra and collapsed lung.
Defence solicitor Kevin Casey said that the accident occurred because McDaid had swerved in an attempt to avoid a pothole, telling the court that he was 'quite shaken' by the incident and hasn't driven since it happened.
He was ordered to pay a fine of £400 and given a twelve month disqualification.
