Derry Magistrate's Court heard today how when a young woman with first aid training stopped to assist a man lying in the street the man is alleged to have sexually assaulted her friend.
Paul Farren (34) of John Street in Derry appeared for a bail application today charged with sexual assault on June 22 this year.
The court heard that a 17-year-old female reported to police that she had been sexually assaulted outside the Iceland store in Foyle Street.
She said herself and a friend had seen a man lying on the street and as the friend had first aid training they stopped to help.
The female said the man told them his name was Paul and sat up, lit a cigarette and then touched her on the breast and kissed her neck.
The woman pushed him away and he allegedly tried to kiss her again before the man was said to have got up and walked away.
She gave police a description and after examining CCTV footage Farren was identified and arrested.
At interview Farren said he had no memory of the incident but confirmed it was him on the CCTV.
A police officer said Farren had shown 'no remorse'.
Bail was opposed due to the risk of re-offending and the fact that Farren's address was unsuitable.
The court heard that Farren had 10 bail breaches on his record.
Defence solicitor Seamus Quigley said that it could be some time before there would be a decision in the case.
He said Farren had 'terrible record' but said he did not know the alleged injured party in the case.
The solicitor said that if Farren was given a no alcohol condition and kept it there would be no offending.
Deputy District Judge Sean O'Hare said he felt the bail application was 'premature' and refused it but said there had to be progress in the case.
Farren was remanded in custody and will appear again later this month.
