Altnagelvin Hospital Emergency Department
A man who exposed himself while in A&E at Altnagelvin Hospital will be sentenced on November 1 after being found guilty of two counts of exposure and two counts of indecent behaviour.
Jordan Gilloway (25) of Ballycolman Estate in Strabane had denied the exposure charges that occurred on November 12 2022.
A witness who had been working as a nurse in A&E on the night in question gave evidence by Sightlink from Australia.
She told the court that while working on that date at about 2am her attention was drawn to Gilloway who had exposed his genitals.
The nurse said that there were other patients in the area at the time and that she asked the defendant to cover up.
She said initially he pulled his top down over his genitals but then exposed himself again.
The witness then said she had covered the defendant with a blanket.
Under cross-examination by Sinead Rogan for Gilloway the witness said the defendant had been brought to A&E by the PSNI.
She agreed that Gilloway was intoxicated at the time of the offending.
Another staff nurse then gave evidence and described the same scene and added that there were two females in the vicinity.
Under cross-examination the nurse said she had a clear view as she was standing at the nurses station at the time.
A police officer gave evidence of cautioning the defendant on the night in question and said Gilloway answered 'aye'.
Ms Rogan then called Gilloway to give evidence on his own behalf.
The defendant said he had no recollection of the incident and said he left the hospital the next morning completely unaware of what had happened.
He said that the first time he became aware of the incident was when he was questioned by police.
When asked about the incident he said he didn't believe he had any intention to do anything like the charge as it was 'not the person I am'.
He told the court that at the time of the offending he had been 'struggling with addiction' but had been clean for 6 months.
Under cross-examination by the prosecution Gilloway said at the time he had been drinking for 'three or four days' and had taken drugs.
In her closing submission Ms Rogan said that her client had accepted the indecent behaviour charges but was too intoxicated to have had any intention as regards the exposure charges.
Deputy District Judge Noel Dunlop said he was satisfied that the case for the exposure charges had been made and convicted Gilloway.
The case was adjourned for the preparation of a pre-sentence report and Gilloway will be sentenced on November 1.
