Suspended sentence for Derry man who assaulted his brother

A man who assaulted his brother has been given a suspended sentence at Derry Magistrate's Court today.

Stephen Benson (28) of Rathkeele Way in Derry admitted a charge of assault on his brother on June 6.

The court heard that police were called at 12.45am after the injured party reported that he had been assaulted by his brother, the defendant.

The injured party reported his brother had returned home at around 12.30am and appeared to be intoxicated. 

An argument ensued and the brother accused Benson of being verbally abusive towards their mother. 

The victim said that Benson then punched him several times around the head and he said he defended himself. 

Police spoke to Benson who appeared to have swelling around his eye.

He accepted he had been abusive towards his mother. 

Defence solicitor Paddy MacDermott said that from appearances the brother seemed 'to have given as good as he got'.

He said that the defendant's mother was 'anxious' to get him home and it was just an argument between two brothers with too much alcohol.

Benson was sentenced to two months in prison suspended for 18 months.
