Derry Court
District Judge Barney McElholm has said that those still opposed to policing on either side have to realise 'their day has gone' as he fined a dissident republican £1,000.
His comments came in the case of Kevin Connolly Brady (41) of Ballymagowan Avenue in the city who was convicted of disorderly behaviour on September 28 last year.
The court was shown bodyworn footage of the PSNI stopping Brady who was accompanied by his 12-years-old son in his car.
In the footage Brady refers to PSNI officers as 'Nazi scum' 'dirty Nazi scum' and 'dirty loyalist scum'.
During the interaction Brady, who was recording the incident, also tells the PSNI officers 'you have a hatred for my community.'
When he is handed the police notice regarding the stop Brady can be seen tearing it up and throwing it away.
A prosecution barrister said that the offence was 'aggravated by hostility' and referred to the 'loyalist scum' remark.
Defence solicitor Paddy MacDermott said that while the incident was 'clearly very unpleasant' he did not believe that it met the threshold for a conviction for disorderly.
He added while his client 'certainly insults the officers' and does raise his voice there is no one else about during the incident.
The solicitor described the incident as 'an unpleasant conversation' rather than disorderly.
Judge McElholm asked 'who does he think he is' tearing up the notice.
He said that the behaviour was 'disgraceful' and made worse by his 12-years-old son 'aping' his father and said the offence was 'verbal but in front of a 12-year-old.'
He convicted Brady of disorderly behaviour and fined him £1,000.
