A preliminary hearing into the death of a Derry dissident republican shot dead by his own organisation has been told that 'high level liaisons' have been taking place with the Gardai in relation to the the inquest.
Kieran Doherty (31) from Coshowen in Derry was found shot dead bound and gagged on the Brae Hill Road on the outskirts of Derry on February 24 2010.
His death was claimed by the group then known as the Real IRA who said Mr Doherty was one of their members and they made various allegations against him.
At today's hearing the Coroner, Judge Brian Sherrard, said that setting a date to look at what material from the PSNI and the Secretary of State should be disclosed was 'difficult' without knowing what material was coming from the Gardai.
A previous hearing had been told that the Gardai were willing to engage with the process and today counsel to the Coroner said that while this process was 'complex' liaisons with Gardai and the Chief State's solicitor office in the Republic were continuing.
The Coroner said that there was no indication that the Gardai were unwilling to assist the process and was told that there was a willingness by the Garda 'to progress this matter and assist'.
Stephen Toal on behalf of the Doherty family said that they were anxious to see the matter progress especially as 'the 13th anniversary of this murder is tomorrow'.
He added that the family had 'full confidence in the Coroner Service' to move the matter on.
It was suggested that perhaps a deadline could be given to the Gardai to disclose whatever material they had.
The Coroner said that that posed difficulties as what was being done was they were asking for the assistance of the Gardai.
He proposed keeping the matter under regular review and suggested that a communication could be sent to the Gardai asking for an 'indicative timescale' as to when they might have material available.
A further preliminary hearing will take place on March 31.
