Abuse of process application in sexual assault hearing against former Derry star Paddy McCourt

Derry Magistrate's Court heard today that former Derry City and Celtic footballer Patrick McCourt will be making an abuse of process application in his case.

McCourt (38) from Wheatfield Court in Muff County Donegal is charged with one count of sexual assault that was said to have occurred on January 30 this year.

At today's hearing a prosecutor told the court that a phone report on the alleged injured party's phone was ready for the defence.

She said that the PPS had supplied an expert report on this phone but this had not been accepted by the defence who wanted there own report.

Defence solicitor Ciaran Shiels asked for a three week adjournment so that an abuse of process application could be lodged. 

The case was adjourned until December 8.
