A man who is accused of kicking another man on the ground in front of police has been granted bail at Derry Magistrate's Court with his final warning.
Dean Elliott (25) of Duddy's Court in Derry appeared charged with being disorderly in Bank Place in the city, criminal damage to a police van and three assaults on police.
All of the offences were said to have occurred on November 20.
A police officer connected the accused to the charges and opposed bail.
He told the court that police received a report of two males fighting in Bank Place at 12.35am.
Police separated the men and were dealing with the other man when Elliot was said to have run up and kicked the other man on the ground.
He then was said to have struggled with police kicking one officer and spitting at another.
When placed on a police van the defendant was alleged to have spat blood in the vehicle requiring a deep clean.
Bail was opposed due to the fact that Elliott had 50 previous convictions and police believed he was a serious risk of committing 'violent offences.'
Defence solicitor Seamus Quigley said that this case was 'all about alcohol'.
He said Elliott was one of those people who accepted they should not drink.
The solicitor said that Elliot was the type that it was almost certain if he drank he would end up in court.
District Judge Barney McElholm said he would release Elliott on bail but was giving him his final warning now.
He said one breach and it would be straight to custody.
Elliott will appear again on December 15.
