A man has appeared at Derry Magistrates' Court following a breach of his bail conditions.
John Paul O'Hagan (42) of Rinmore Drive in Derry was arrested on February 6 following a report from Altnagelvin Hospital that a man had left before he could be treated.
Police found him struggling to walk in John Street where he provided a breath sample of 85mg. He was also found to be in possession of a bottle of Jägermeister.
Police arrested him as one of his bail conditions included not to be intoxicated in public.
The court heard that this was O'Hagan's third breach of the same condition. He also has 71 previous convictions.
Police objected to bail as they believe there is 'zero chance' of him obeying conditions set by the court.
Defence Barrister Stephen Mooney said that 'none of the facts are disputed', telling the court that O'Hagan had taken a few drinks at home and had gone to the hospital for an unknown reason.
Staff subsequently called the police due to concerns for his mental health.
Mr Mooney described O'Hagan as a 'chronic alcoholic' but added that he did not actually commit any offences while drunk.
District Judge Barney McElhom granted bail, removing the condition prohibiting alcohol but telling O'Hagan that it was his 'final warning'.
He will appear again on February 24.
