Derry man fined for possessing pregablin tablets

Suspended sentence for Donegal man at Derry Magistrate's Court

Derry Magistrates' Court

A man who was 'unlucky' enough to be in custody on two occasions and was found with pregablin he claimed he knew nothing about has been fined at Derry Magistrates' Court.

James Kelly (37) of Waterloo Place in Derry admitted two charges of possessing the drug on December 11 and January 26.

The court heard that Kelly was in custody on December 11 on other matters and during a search one pregabalin tablet was found on him.

When interviewed he told police he couldn't account for the presence of the tablet in his pocket.

Then on January 26 a female requested police to remove Kelly from her home.

He did not want to leave and was taken into custody and while there a tablet was found in his back pack.

Again Kelly claimed he didn't know how the tablet came to be there.

Defence solicitor Seamus Quigley asked for credit for his client as he had not wasted the court's time trying to argue how unlucky he was to be found twice with tablets.

He said Kelly was 'struggling with issues'.

Kelly was fined a total of £350.
