Decision to be taken in Annette McGavigan case, two days before Legacy Act deadline

The Public Prosecution Service has confirmed today that a decision as to whether army personnel will be prosecuted for the fatal shooting of Derry teenager Annette McGavigan will be made on Monday, April 29

Annette McGavigan was shot in 1971 as she watched a riot.

The Public Prosecution Service (PPS) has confirmed today that a prosecutorial decision as to whether army personnel will be prosecuted for the fatal shooting of 14 year old Annette McGavigan in Derry on September 6, 1971 will be announced on Monday, April 29.

The decision as to whether army personnel will be prosecuted for the child's killing will be announced from Belfast just two days in advance of the statutory deadline for all prosecution decisions on legacy cases in Northern Ireland in accordance with the Legacy Act 2023.

The siblings of Annette McGavigan, her sister May and brothers Martin and Kevin, with the Pat Finucane Centre, have campaigned for over 20 years for an Article 2 compliant criminal investigation, a referral to the PPS and a fresh inquest into the exact circumstances of the fatal shooting of their sister.
