Disqualification for Derry man who went through police checkpoint

When stopped Kearney was caught driving with excess alcohol

Man returned for trial to Derry Crown Court on 28 charges

Derry Court

A man who is planning to 'make a new life' in the United States in the next few weeks went through a police checkpoint and was caught driving with excess alcohol.

Caolan Kearney (24) of Ard Grange in Derry admitted a charge of driving with excess alcohol on December 10.

The court heard that police had a vehicle checkpoint and a car driven by Kearney went through it and was later stopped on the Buncrana Road.

He failed a preliminary breath test and an evidential test revealed a reading of 63mgs with the legal limit being 35mgs.

A defence solicitor, Ciaran Hampson, told the court that the reason Kearney was in court today was that he was intending to move to the United States in a matter of weeks.

He asked the court to take the defendant's age and clear record into account.

Kearney was disqualified for 12 months and fined £250.
