Derry Court: Man (35) accused of assault on partner and child

Man returned for trial to Derry Crown Court on 28 charges

Derry Magistrate's Court heard today that a man from Park village is accused of assaulting his partner and his 4-year-old son during a domestic incident.

Octavian Moisi (35) of Glengrainne Gardens in Park appeared charged with assaulting a female and a child on May 21.

He was also charged with making a threat to kill the woman on the same date. 

Moisi was further charged with engaging in a course of action that could be deemed to be domestic abuse during 2023.

A police officer connected the accused to the charges. 

He told the court that police were called to a report of a domestic incident by a third party who claimed they coukd hear a child crying. 

The alleged victim told police that Moisi had punched her and pushed her against a wall. 

She alleged that the defc defendant had made a threat to kill her and that their 4-year-old child was present during the incident.

Later the woman made a statement to police in which she said the defendant had choked her briefly during the incident and had slapped the child. 

She also alleged he controlled her finances and checked her phone. 

At interview Moisi denied all the offences and claimed the woman had assaulted him. 

The court heard that there was no previous domestic history. 

The police officer said police would not oppose bail if an address could be found 'far enough away.'

Defence solicitor Seamus Quigley said that his client had been living here for the last 11 years although his family was in Romania. 

He said that the defendant had answered every question put to him and made 'a strong denial'.

The solicitor said that Moisi worked in Cork and had an address there and 'you could not get any further away.'

He was released on bail with a £1,000 cash surety, to have no contact with the alleged victim and to reside at an address in Cork.

He will appear again on June 14.
