Derry Court: Man 'deliberately' breached his bail on domestic abuse charges

Thomas Rush, with 101 previous convictions, received suspended sentence on Friday and breached bail on Sunday

A man who was given a suspended sentence at Derry Magistrate's Court on Friday for a hospital assault within days  'deliberately' breached his bail on domestic abuse charges.

Thomas Rush (39) of Glengalliagh Park in Derry appeared charged with breaching his bail on March 5 and 6.

The court heard that police were called to a report of a domestic incident when the defendant was said to have been at his former partner's home on March 5.

In the early hours of March 6 the defendant was said to have been at the alleged victim's home and texted her to say he was inside her flat.

This was in breach of bail conditions prohibiting him from entering the Waterside area.

Rush was found inside the flat and arrested.

A police officer said that they had no confidence that Rush would abide by conditions and said Rush had 101 previous convictions.

Defence solicitor Seamus Quigley said his client said he had gone to get clothing.

He accepted Rush had 'a terrible record'.

District Judge Barney McElholm said that this man had been in court on Friday and then had gone out and breached his bail like this.

He said he could not even 'dream' that this man would abide by any conditions and said the defendant had to learn if he did not abide by his bail 'there would be consequences'.

Rush will appear again on March 9.
