Derry Court: Former soldier charged with drug and driving offences

Man returned for trial to Derry Crown Court on 28 charges

When police attended an incident in Shipquay Street in Derry they had occasion to search a former soldier in the Irish army and they found cocaine and Pregablin the local Magistrate's Court heard today.

Barry Fitzgerald (33) of Alma Place in Derry admitted possessing the drugs on December 27 2022.

The court heard that Fitzgerald made full admissions to possessing the drugs and said the cocaine was for personal use and the Pregablin for pain relief.

The court was then told about another incident on December 8 last year.

On that date ambulance staff contacted police about a suspected overdose.

They found Fitzgerald 'slumped over the steering wheel' of a vehicle and he was difficult to rouse.

The court heard that there were both full and empty wine bottles in the vehicle.

After he was roused Fitzgerald refused to give a sample of breath.

When questioned about having no insurance he said he had only bought the vehicle.

Defence solicitor Seamus Quigley said his client was a former soldier in the Irish army who had developed issues with drugs.

He said he was 'doing great harm to himself' and added that Fitzgerald's mother was hoping he would seek professional assistance on release.

Fitzgerald was fined £500 and disqualified for 8 months.
