Judge remands Derry man after bail conditions violated

Defendant refused bail after violating exclusion order and losing residence
A man has been remanded in custody at Derry Magistrate's Court today after the court heard he had lasted 18 days before breaching his bail.
Luke McCormick (38) of Springvale Park in Derry was on bail for domestic offences and part of his conditions was that he was not to be in the Rosemount Avenue area of the city.
The court was told that McCormick was located in the Rosemount Avenue area from which he is excluded and also that his parents had withdrawn his bail address.
A police officer told the court that the original offences involve an incident in Brooke Park where a witness claimed he heard a woman shouting 'get him off me' as the defendant was allegedly on top of her.
He added that the defendant's parents had withdrawn the address he was residing at and also that he was located in Rosemount Avenue an area from which he is excluded from.
Bail was opposed as the court heard that McCormick was only granted bail on July 8 so he lasted 18 days before breaching.
The officer said that the defendant only had three bail conditions and had breached two of them.
Defence solicitor Paddy MacDermott asked the officer if McCormick had being doing anything other than being in Rosemount Avenue and was told he had not.
The solicitor added that the two offences McCormick is charged with were not the most serious.
He said it could be some time before the case was dealt with and asked for bail to an address approved by police.
As regards his parents removing the address for the defendant the solicitor said it could be they simply wanted to give him 'a short sharp shock'.
District Judge Oonagh Mullan said that she was refusing bail but said that the case could be revisited if an appropriate address was found.
He will appear again on August 5.
